As Vitalya Home Companionship and Social Support Services ('Vitalya'), in our capacity as data controller under the Turkish Personal Data Protection Law No. 6698 ('KVKK'), we have prepared this disclosure text to inform you regarding the processing of your personal data.

Important Notice: Vitalya is not a medical diagnosis, treatment or healthcare institution. The services offered are limited to individual companionship and social life support. The data processing activities described in this text relate solely to companionship and social support services.

  • Measuring, improving and enhancing service quality.
  • Providing information to authorized institutions and organizations as required by applicable legislation.
  • Storing website language preferences and improving user experience.
  • Execution of information security processes.

4. Transfer of Personal Data

Your collected personal data may be transferred to the following parties in accordance with the personal data transfer conditions set forth in Articles 8 and 9 of the KVKK:

  • Legal Obligation: To authorized public institutions and organizations (courts, prosecutors' offices, etc.) pursuant to applicable legislation.

  • Processing of personal data belonging to the parties of a contract is necessary, provided that it is directly related to the establishment or performance of a contract (KVKK Art. 5/2-c).
  • Processing is mandatory for the data controller to fulfill its legal obligation (KVKK Art. 5/2-c).
  • Processing is mandatory for the legitimate interests of the data controller, provided that it does not prejudice the fundamental rights and freedoms of the data subject (KVKK Art. 5/2-f).
  • Explicit consent of the data subject (KVKK Art. 5/1).

6. Rights of the Data Subject (KVKK Article 11)

Pursuant to Article 11 of the KVKK, as a personal data subject, you have the following rights:

  • a) To learn whether your personal data is being processed.
  • b) To request information if your personal data has been processed.
  • c) To learn the purpose of processing your personal data and whether they are used in accordance with their purpose.
  • d) To know the third parties to whom your personal data has been transferred domestically or abroad.
  • e) To request the correction of your personal data if it has been processed incompletely or inaccurately.
  • f) To request the deletion or destruction of your personal data within the framework of the conditions set forth in Article 7 of the KVKK.
  • g) To request that operations carried out pursuant to paragraphs (e) and (f) be notified to third parties to whom your personal data has been transferred.
  • h) To object to the emergence of a result against you through the analysis of your processed data exclusively by automated systems.
  • i) To claim compensation for damages arising from the unlawful processing of your personal data.

7. Application Methods

You may apply to us through the following methods to exercise the rights set forth above:

7.1. Written Application

You may submit your petition containing your request regarding your rights, together with documents verifying your identity, to the address 'Antalya, Turkey' in person or by registered mail with return receipt via notary public.

7.2. Application by Email

You may submit your application to info@vitalya.com.tr through your registered electronic mail (KEP) address or the email address registered in our system.

7.3. Application Content

Your application must contain the following information:

  • First name, last name, and signature if the application is written.
  • Turkish Republic identification number for Turkish citizens; nationality, passport number or identification number (if any) for foreign nationals.
  • Residential or business address for notification purposes.
  • Email address, phone and fax number for notification purposes, if any.
  • Subject of the request.

7.4. Response Period

Your application shall be concluded free of charge as soon as possible and within 30 (thirty) days at the latest, depending on the nature of your request. However, if the process requires additional cost, the fee determined by the Personal Data Protection Board may be charged.

8. Updates to the Disclosure Text

This disclosure text may be updated in accordance with legal regulations and changes in our data processing activities. Updates take effect upon publication on our website.
